Terms of Service

COACH–CLIENT RELATIONSHIP

A. Josiane Paiement (the “Coach”) agrees to respect the scope of practice, the code of ethics, and the confidentiality policy established by the Health Coach Alliance. More information can be provided upon request.

B. The Client is fully responsible for creating and implementing their own decisions, choices, actions, and results regarding their physical, mental, and emotional well‑being arising from, or related to, their coaching relationship with the Coach. The Client therefore agrees that the Coach is not, and cannot be, held liable for any action or inaction, or for any direct or indirect result stemming from the services provided by the Coach. The Client understands that coaching is not therapy and cannot replace therapy, when needed, and cannot prevent, cure, or treat mental or other illnesses.

C. The Client acknowledges that coaching is a comprehensive process that may involve various areas of their life, including health, interpersonal relationships, sleep, work, and leisure. The Client agrees that any decision regarding how to:

  1. manage issues identified through this process

  2. incorporate ideas or information raised during coaching into these areas

  3. implement any habit changes

is entirely the Client’s responsibility.

D. The Client understands that the Coach is not a physician and that the scope of coaching services does not include diagnosing or treating illnesses or specific medical conditions. The Coach cannot be held responsible for failing to diagnose or treat an illness, nor for failing to prevent a future illness. If the Client suspects they may have a condition requiring medical attention, they will consult a licensed physician or other qualified healthcare provider without delay. Only a licensed healthcare provider can prescribe medication. Any mention of medication during coaching sessions is solely for the purpose of establishing a complete list of medications taken by the Client, and not for the Coach to assess their appropriateness. Any change in dosage or medication must be decided by the Client in collaboration with the prescribing healthcare provider. Although improved well‑being and better health may result from adopting healthier behaviors and lifestyle habits, the Coach does not promise or guarantee that these will prevent any future illness.

E. To optimize the coaching relationship, the Client agrees to:

  1. communicate honestly

  2. be open to receiving support and feedback

  3. invest the necessary time and energy to participate fully and actively in each coaching session

F. The Coach and the Client mutually acknowledge that they may discuss future plans, business matters, client lists, financial information, employment‑related information, aspirations, personal information, and other types of private information. The Coach will not voluntarily disclose this Client information to any third party unless legally required to do so. To protect and respect the Coach’s intellectual property, the Client also agrees not to disclose or share any information related to the Coach’s methods, documents, or other materials with any third party.

LIMITED LIABILITY

Unless otherwise stated in this agreement, the Coach makes no guarantees or representations of any kind, express or implied, regarding the coaching services negotiated, accepted, and provided. Under no circumstances shall the Coach be held liable for any indirect, consequential, or special damages incurred by the Client. Regardless of any damages the Client may incur, the Coach’s total liability under this agreement — and the Client’s sole remedy — shall be limited to the amount actually paid by the Client to the Coach under this agreement for all services rendered up to and including the termination date of this agreement.
