COACH-CLIENT RELATIONSHIP

A. Josiane Paiement (the "Coach") agrees to abide by the scope of practice, code of ethics, and confidentiality policy established by the Health Coach Alliance . Further information is available upon request.

B. The Client is fully responsible for creating and implementing their own decisions, choices, actions, and outcomes regarding their physical, mental, and emotional well-being, arising from or related to their coaching relationship with the Coach. The Client therefore agrees that the Coach is not, and cannot be held, liable for any action or inaction, nor for any direct or indirect result arising from the services provided by the Coach. The Client understands that coaching is not therapy, cannot replace therapy when necessary, and cannot prevent, cure, or treat illnesses, whether mental or otherwise.

C. The Client acknowledges that coaching is a comprehensive process that can affect various areas of their life, including health, interpersonal relationships, sleep, work, and leisure. The Client agrees that any decision regarding how to:

(1) manage the issues that can be identified through this process

(2) integrate the ideas or information raised during the coaching sessions into these different areas

(3) implement any change in habits

it is entirely his responsibility.

D. The Client understands that the Coach is not a physician and that the scope of their services does not include the diagnosis or treatment of specific illnesses or medical conditions. Therefore, the Coach cannot be held responsible for failing to diagnose or treat an illness, nor for failing to prevent one in the future. If the Client suspects they have a condition requiring medical attention, they will consult a physician or other licensed healthcare professional without delay. Only a licensed healthcare professional can prescribe medication. Any mention of medication during coaching sessions is solely for the purpose of creating a comprehensive list of medications taken by the Client, and not for evaluating their appropriateness. Any change in dosage or medication is a decision that must be made by the Client, in consultation with the person who prescribed the medication. While improved well-being may result from adopting healthier attitudes and lifestyle habits, the Coach does not promise or guarantee that these will prevent any future illness.

E. In order to optimize the coaching relationship, the Client agrees to:

(1) communicate honestly

(2) be open to support and feedback

(3) invest the necessary time and energy to participate fully and actively in each session

F. The Coach and the Client mutually acknowledge that they may discuss future plans, business matters, client lists, financial information, employment-related information, aspirations, personal information, and other types of private information. The Coach will not voluntarily disclose this information to any third party unless required by law. In order to protect and respect the Coach's intellectual property, the Client also agrees not to disclose or share the Coach's methods, documents, or other materials with any third party.

LIMITED LIABILITY

Unless otherwise stated in this agreement, the Coach makes no warranties or representations, express or implied, regarding the coaching services negotiated, accepted, and provided. The Coach shall not be liable for any indirect, consequential, or special damages incurred by the Client. Notwithstanding any damages that may be incurred by the Client, the Coach's total liability under this agreement, and the Client's sole remedy, shall be limited to the amount actually paid by the Client to the Coach for all services rendered up to and including the termination date of this agreement.
